These Terms of Service ('Terms') govern your access to and use of www.stakdclub.com (the 'Site') and your purchase of products from STAKD CLUB ('we', 'us', 'our'). By accessing the Site or placing an order, you agree to these Terms.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to purchase from the Site, or have the consent of a parent or guardian.

2. Products, pricing and availability

We aim to display our products and prices accurately, but we do not warrant that product descriptions, colours, pricing, or other content are error-free. Prices and availability may change without notice, and prices are shown in the applicable currency. We may limit quantities, refuse or cancel orders, and correct errors, including after an order has been submitted.

3. Orders and acceptance

Your order is an offer to purchase. We accept your order when we send confirmation or dispatch the product. If we cancel an order after payment, we will refund the amount paid.

4. Payment

Payment is processed by our third-party payment providers. You confirm that you are authorised to use the payment method you provide.

5. Shipping, duties and import taxes

Shipping times and costs are estimates and are shown at checkout and in our Shipping Policy. For international orders, any applicable duties and import taxes are calculated and displayed at checkout where required and are payable by you as part of your order total. Our Shipping Policy and Refund Policy form part of these Terms.

6. Returns and refunds

Returns and refunds are governed by our Refund Policy, available on the Site.

7. Product use and disclaimers

Our products are gym and lifestyle towels and accessories, provided 'as is' and 'as available'. To the maximum extent permitted by law, we disclaim warranties not expressly stated, including implied warranties of merchantability and fitness for a particular purpose. We make no medical, antimicrobial, or health-protective claims about our products beyond those expressly stated and substantiated. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee or right that cannot lawfully be excluded, including under the Australian Consumer Law or applicable consumer protection laws where you live.

8. Intellectual property

All content on the Site, including the STAKD CLUB name, logos, designs, images, and text, is owned by us or our licensors and protected by intellectual property laws. You may not copy, reproduce, or use it without our prior written permission.

9. Reviews and user content

If you submit reviews or other content, you grant us a non-exclusive, royalty-free, worldwide licence to use, display, and reproduce it in connection with our business. You are responsible for what you submit and must not post anything unlawful, misleading, or infringing.

10. Acceptable use

You agree not to use the Site for any unlawful purpose, to interfere with its operation or security, or to attempt unauthorised access to any part of it.

11. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential loss arising from your use of the Site or products, and our total liability will not exceed the amount you paid for the relevant order. Nothing here limits liability that cannot be limited under applicable law, including non-excludable consumer guarantees.

12. Indemnification

You agree to indemnify and hold us harmless from claims, losses, or expenses arising from your breach of these Terms or misuse of the Site.

13. Governing law

These Terms are governed by the laws of New South Wales, Australia, without regard to conflict-of-law rules, and disputes are subject to the non-exclusive jurisdiction of the courts of New South Wales, Australia. These provisions do not deprive you of any mandatory consumer protections of the country or state where you reside.

14. Changes to these Terms

We may update these Terms from time to time. The version in effect when you place an order applies to that order, and continued use of the Site after changes means you accept them.
